Is the Poopsie about to hit the fan?
MGA Entertainment — the company behind the holiday toy sensation, the Poopsie Slime Surprise Unicorn — has filed a preemptive lawsuit against luxury designer Louis Vuitton.
Poopsie, a wide-eyed unicorn who slides out a pile of glittery slime at the press of a button, has a number of accessories, sold separately. Among them is a $60 poop-shaped purse, filled with additional slime-making tools, with the cheeky name “Pooey Puitton.”
The Pooey Puitton handbag is white with small pastel-colored designs that resemble a recognizable colorway of Louis Vuitton’s famous Tuileries monogram pattern. Vuitton has been trying to block production of MGA’s tongue-in-cheek product since early last month, according to a post on the respected blog the Fashion Law.
MGA Entertainment’s suit is an attempt to block any official claims of trademark infringement. In it, the California toymaker defends its purse as parody, and says that “no reasonable customer would mistake the Pooey product for a Louis Vuitton handbag” (as Julie Zerbo of Fashion Law explains, the potential to confuse one product for another is critical in any trademark case).
“The Pooey name and product are designed to mock, criticize and make fun of . . . wealth and celebrity,” the manufacturer argues.
Meanwhile, a rep for Louis Vuitton told Reuters that the brand had no comment.
